6. Shipping and Data Handling Obligations

  • Consignors handle all shipping, including packaging, tracking, insurance, and customs.

  • Buyer data may only be used for shipping purposes and must be deleted after use.

7. Prohibited Actions

  • Listing stolen goods, counterfeits, or infringing items.
  • Providing false/misleading descriptions or photos.
  • Direct dealings with buyers outside Mandarake’s system.
  • Violations may lead to listing cancellation, suspension, deposit forfeiture, and liability for damages.

8. Cancellation and Penalties

  • Cancellation fees apply based on auction stage (5%–20% of starting price).
  • Penalties may apply even before auction notice is published.
  • Force majeure cases may be handled separately.

9. Liability and Disclaimers

  • Mandarake disclaims liability for auction outcomes, payment defaults, shipping risks, and system failures (except in cases of gross negligence).
  • Consignors bear full responsibility for shipping and insurance.

10. Legal Jurisdiction, Amendments, and Anti-Social Force Clause

  • Governing law: Japanese law.
  • Jurisdiction: Tokyo District Court.
  • Mandarake may amend terms with prior notice of significant changes.
  • Consignors must have no ties to criminal or anti-social organizations.
