1. Service Overview

4. Auction Sales and After-Sale Responsibilities

- Consignors must ship within 3 days of payment confirmation.
- Buyers have 5 days after delivery to dispute authenticity or condition.
- Returns only allowed for serious issues (e.g., counterfeit items).
- In case of approved returns, consignor bears all costs.
5. Fees and Deposits
- Listing is free. Applicable fees include:
- 20% sales commission on successful transactions.
- Authenticity appraisal fees (if requested).
- 5% refundable deposit on the starting price (subject to forfeiture for violations).
6. Shipping and Data Handling Obligations
- Consignors handle all shipping, including packaging, tracking, insurance, and customs.
- Shipping details must be reported to Mandarake.
- Buyer data may only be used for shipping purposes and must be deleted after use.
7. Prohibited Actions
- Listing stolen goods, counterfeits, or infringing items.
- Providing false/misleading descriptions or photos.
- Direct dealings with buyers outside Mandarake’s system.
- Violations may lead to listing cancellation, suspension, deposit forfeiture, and liability for damages.
8. Cancellation and Penalties
- Cancellation fees apply based on auction stage (5%–20% of starting price).
- Penalties may apply even before auction notice is published.
- Force majeure cases may be handled separately.
9. Liability and Disclaimers
- Mandarake disclaims liability for auction outcomes, payment defaults, shipping risks, and system failures (except in cases of gross negligence).
- Consignors bear full responsibility for shipping and insurance.
10. Legal Jurisdiction, Amendments, and Anti-Social Force Clause
- Governing law: Japanese law.
- Jurisdiction: Tokyo District Court.
- Mandarake may amend terms with prior notice of significant changes.
- Consignors must have no ties to criminal or anti-social organizations.
